Action plan for pollution prevention of waste lead storage battery
In recent years, with the large-scale application of lead batteries in the fields of automobiles, electric bicycles and energy storage, China’s lead battery and recycled lead industry have developed rapidly. There are a large number of discarded lead-acid batteries, and the recycling of lead-acid batteries has high resource and environmental value. However, the sources of waste lead-acid batteries are extensive and scattered, and some informal enterprises and individuals seek illegal interests, which leads to the repeated prohibition of illegal collection and treatment of waste lead-acid batteries, which seriously harms people’s health and ecological environment safety. In accordance with the decision-making arrangements of the CPC Central Committee and the State Council on comprehensively strengthening the ecological environment protection and fighting the tough battle of pollution prevention and control, this scheme is formulated in order to strengthen the pollution prevention and control of waste lead storage batteries, improve the comprehensive utilization level of resources, promote the standardized and orderly development of lead storage battery production and recycled lead industry, and protect the ecological environment safety and people’s health.
一、总体要求
(一)指导思想
全面贯彻党的十九大和十九届二中、三中全会精神,以习近平新时代中国特色社会主义思想为指导,深入落实习近平生态文明思想和全国生态环境保护大会精神,认真落实党中央、国务院决策部署,坚持和贯彻绿色发展理念,将废铅蓄电池污染防治作为打好污染防治攻坚战的重要内容,以有效防控环境风险为目标,以提高废铅蓄电池规范收集处理率为主线,完善源头严防、过程严管、后果严惩的监管体系,严厉打击涉废铅蓄电池违法犯罪行为,建立规范的废铅蓄电池收集处理体系,有效遏制非法收集处理造成的环境污染,维护国家生态环境安全,保护人民群众身体健康。
(二)基本原则
坚持疏堵结合、标本兼治。完善废铅蓄电池收集、贮存、转移、利用处置管理制度,支持铅蓄电池生产企业和再生铅企业建立正规收集处理体系;持续保持高压态势,严厉打击非法收集处理违法犯罪行为。
Adhere to classified policies and comprehensive management. According to environmental risks, objective conditions of collection and treatment and other factors, the management and control requirements for collection and treatment of waste lead-acid batteries are reasonably determined by classification; Comprehensive use of legal, economic and administrative means to carry out life cycle management and improve the joint reward and punishment mechanism.
Adhere to coordination and cooperation and pay close attention to implementation. All departments work closely together according to the division of responsibilities and make concerted efforts to form a joint effort; Strengthen follow-up supervision to ensure that all tasks are effective; All localities earnestly implement the main responsibility and do a good job in pollution control and collection and treatment system construction of waste lead storage batteries.
Adhere to pluralistic participation and common governance by the whole people. Strengthen publicity and education on pollution prevention of lead-acid batteries, and guide relevant enterprises, public institutions and the public to actively participate in the standardized collection and treatment of waste lead-acid batteries; Strengthen information disclosure and improve the public supervision and reporting mechanism.
(III) Main objectives
In accordance with the requirements of the State Council’s Notice on Printing and Distributing the 13th Five-Year Plan for Ecological Environmental Protection (Guo Fa [2016] No.65) and the State Council General Office’s Notice on Printing and Distributing the Implementation Plan of Extended Producer Responsibility System (Guo Ban Fa [2016] No.99), the illegal collection and treatment of waste lead batteries will be rectified, and the extended producer responsibility system will be implemented to improve the standardized collection and treatment rate of waste lead batteries. By 2020, lead-acid battery manufacturers will realize the standardized collection rate of waste lead-acid batteries by implementing the extended producer responsibility system; By 2025, the standard collection rate of waste lead-acid batteries will reach 70%; Standardize the safe use and disposal of all collected waste lead batteries.
Second, promote the green development of lead-acid battery production industry
(four) to establish a list of enterprises in lead-acid battery related industries.Establish lists of key enterprises such as lead storage battery production, primary lead and recycled lead respectively, and make them public and dynamically updated.. (The Ministry of Ecology and Environment and relevant departments of local governments (hereinafter all including relevant departments of local governments, which will not be repeated) are responsible for the implementation and will be completed before the end of June 2019)
(5) Severely crack down on illegal production and sales.Take lead-acid batteries as key commodities, and continue to crack down on illegal production and sale of counterfeit and shoddy lead-acid batteries according to law.(The General Administration of Market Supervision is responsible for long-term implementation)
(6) Vigorously promote cleaner production.For enterprises listed in the list of lead storage battery production, primary lead and secondary lead enterprises, compulsory cleaner production audit shall be implemented according to law, and the interval between two cleaner production audits shall not exceed five years.. (seven) to promote the lead-acid battery producer responsibility extension system.Formulate and issue management measures for recycling lead-acid batteries, and implement extended producer responsibility.(The Development and Reform Commission and the Ministry of Ecology and Environment are responsible for implementation and will be completed before the end of 2019)Give full play to the leading role of lead-acid battery production and lead recycling backbone enterprises, encourage recycling enterprises to establish a reverse recycling system based on the manufacturer’s marketing network, and lead-acid battery production enterprises and importers establish a standardized recycling system through self-built recycling system or cooperation with social recycling system. Encourage lead battery manufacturers to carry out ecological design and increase the proportion of recycled raw materials; Encourage lead battery manufacturers and lead smelting enterprises to complement each other, and support the use of existing lead smelting technology and equipment to treat waste lead batteries. Strengthen the management of recycled lead enterprises and promote the scale and clean development of recycled lead enterprises.(The Development and Reform Commission, the Ministry of Industry and Information Technology and the Ministry of Ecology and Environment are responsible for long-term implementation according to their functions)
Third, improve the collection system of waste lead batteries
(eight) improve the supporting legal system.Amend the Law of People’s Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, and clarify the extended producer responsibility system and the collection and licensing system of waste lead batteries;(Ministry of Ecology and Environment and Ministry of Justice are responsible for implementation)Revise the Measures for the Management of Hazardous Waste Transfer Joint List to improve the transfer management requirements;(The Ministry of Ecology and Environment and the Ministry of Transport are responsible for the implementation and will be completed before the end of 2019)Revise the National Hazardous Waste List, and put forward exemption management requirements for collection, storage and transfer under the premise of risk control.(The Ministry of Ecology and Environment, the Development and Reform Commission, the Ministry of Public Security and the Ministry of Transport are responsible for the implementation and will be completed before the end of 2019)
(nine) to carry out the pilot system of centralized collection and trans-regional transportation of waste lead batteries.In order to explore and improve the management system of collection and transfer of waste lead-acid batteries, a pilot system of centralized collection and trans-regional transfer of waste lead-acid batteries is carried out in a conditional area, and the requirements for collection, storage and transfer of undamaged sealed maintenance-free waste lead-acid batteries are conditionally exempted or simplified, so as to reduce costs, improve efficiency and promote the establishment of a standardized and orderly collection and treatment system.(The Ministry of Ecology and Environment and the Ministry of Transport are responsible for the implementation, which will be completed before the end of 2020)
(ten) to strengthen the management of waste lead-acid batteries in the automobile maintenance industry.Strengthen the training and guidance on the sources of waste lead-acid batteries such as vehicle maintenance enterprises (Class I and II), and urge them to deliver waste lead-acid batteries to formal collection and treatment channels according to laws and regulations, and incorporate them into relevant qualification management or assessment and rating index system.(The Ministry of Transport and the Ministry of Ecology and Environment are responsible for long-term implementation and will start in 2019)
Four, strengthen the standardized management of recycled lead industry
(eleven) strict management of waste lead storage battery business license access.Formulate and publish guidelines for the examination of hazardous waste business license of waste lead-acid batteries, revise the Technical Specification for Pollution Control of Waste Lead-acid Batteries, strictly permit conditions, and prohibit enterprises that have no legal ability to recycle lead from disassembling waste lead batteries.(The Ministry of Ecology and Environment is responsible for the implementation, which will be completed before the end of 2019)
(twelve) to strengthen the standardized management of hazardous waste in recycled lead enterprises.Take recycled lead enterprises as the focus of standardized management of hazardous waste, and improve the standardized management level of hazardous waste in recycled lead enterprises.(The Ministry of Ecology and Environment is responsible for long-term implementation)Recycled lead enterprises should install automatic monitoring and video monitoring equipment in accordance with the law (that is, "installation"), set up an electronic display screen at the gate of the factory for information disclosure (that is, "tree"), and gradually connect real-time monitoring data with ecological and environmental departments at all levels (that is, "link") to realize information management.(The Ministry of Ecology and Environment is responsible for the implementation, which will be completed before the end of 2020)
Five, severely crack down on illegal and criminal acts involving waste lead batteries.
(thirteen) severely crack down on and severely investigate and deal with illegal and criminal acts involving waste lead storage battery enterprises.Severely crack down on illegal environmental crimes such as illegal collection and dismantling of waste lead batteries and illegal smelting and recycling of lead.(The Ministry of Ecology and Environment and the Ministry of Public Security are responsible for long-term implementation)Strengthen the inspection of illegal acts involving waste lead storage batteries in lead storage battery production enterprises, primary lead enterprises and recycled lead enterprises, and investigate and deal with such acts as receiving waste lead storage batteries without a hazardous waste business license, failing to implement the hazardous waste transfer manifest system as required, illegally disposing of waste acid solution, and illegally receiving "acid-poured" batteries, recycled crude lead and lead paste lead plates.(The Ministry of Ecology and Environment and the General Administration of Market Supervision are responsible for long-term implementation)
(fourteen) to strengthen the tax supervision of recycled lead enterprises.Conduct daily verification and risk assessment on the tax implementation of recycled lead enterprises, and carry out tax inspection according to law for enterprises suspected of serious tax violations such as tax evasion and fraud and false invoicing.(The State Administration of Taxation is responsible for long-term implementation)
(fifteen) to carry out joint punishment.The information about illegal enterprises and personnel involved in waste lead batteries will be included in the list of illegal and untrustworthy in the field of ecological environment, publicized on the national credit information sharing platform, the website of Credit China and the national enterprise credit information publicity system, publicly exposed and jointly punished.(The Ministry of Ecology and Environment, the Development and Reform Commission, the Ministry of Public Security, the Ministry of Transport, the State Administration of Taxation, and the General Administration of Market Supervision are responsible for long-term implementation and will be launched in 2019)
Sixth, establish a long-term guarantee mechanism
(sixteen) the implementation of relevant preferential tax policies.We will implement the current preferential value-added tax policy for comprehensive utilization of resources, and enterprises that use waste lead batteries to produce recycled lead can enjoy preferential tax policies according to regulations to support the development of waste lead battery treatment industry.(The Ministry of Finance and the State Administration of Taxation are responsible for long-term implementation)
(seventeen) to improve the level of information management.Establish a lead-acid battery life cycle traceability system to promote the implementation of a unified coding specification.(The Ministry of Industry and Information Technology, the General Administration of Market Supervision, the Development and Reform Commission and the Ministry of Ecology and Environment are responsible for the implementation, which will be completed before the end of 2020)Establish a public information service platform for the collection and treatment of waste lead-acid batteries, connect all the standardized collection and treatment information of waste lead-acid batteries to the platform, and connect with the lead-acid battery production management information system established by relevant authorities, and gradually realize the traceability of the whole process of lead-acid battery production, transportation, sales, abandonment, collection, storage, transshipment, utilization and disposal information.(The Ministry of Ecology and Environment, the Ministry of Industry and Information Technology and the General Administration of Market Supervision are responsible for long-term implementation)
(eighteen) establish and improve the long-term mechanism of inspector accountability.In areas where the problem of illegal collection of waste lead storage batteries and illegal smelting and recycling of lead is prominent, and the masses have strongly reflected it, causing serious environmental pollution, special inspectors of acupoint type and mobile type will be carried out as appropriate, and interviews will be conducted or accountability will be handed over to the verified dereliction of duty.(The Ministry of Ecology and Environment is responsible for long-term implementation)
(nineteen) to encourage public participation.Carry out education and training on the environmental health hazards of waste lead batteries, widely publicize the relevant policies on the collection and treatment of waste lead batteries, and set up standardized collection and treatment tips in motor vehicle 4S shops, vehicle maintenance enterprises (Class I and II), electric bicycle sales and maintenance enterprises and lead battery sales places to promote the collection and treatment rate of waste lead batteries in formal channels.(The Ministry of Ecology and Environment and the Ministry of Transport are respectively responsible for long-term implementation)Encourage reward reporting, and encourage the public to supervise and report illegal and criminal acts such as illegal collection, illegal smelting of recycled lead, tax evasion, and production of counterfeit and shoddy batteries through telephone, letter, e-mail, government website and WeChat platform.(The Ministry of Ecology and Environment, the Ministry of Public Security, the State Administration of Taxation and the General Administration of Market Supervision are responsible for the long-term implementation)
